The ninth circuit court has maintained a ban on deploying state troops in the Oregon city, following a recent legal decision.

Judicial Panel Concurs to Reconsider Case

The federal appeals court decided on Tuesday that it would reexamine the case concerning the president’s authority with an expanded group of eleven justices. The court also overturned a earlier ruling from a smaller judicial group that had sided with the administration.

Legal Saga Over Troop Deployment

This order represents the latest development in a protracted legal battle over whether the former president has the legal right and justification to deploy national guard forces in the city. Approximately 200 federalized guard members have been in uncertainty since late September when the deployment effort was initiated in due to ongoing demonstrations.

Differing Viewpoints

The administration has claimed that federal officials at the immigration center in the southern part of the city were facing threats, while city and state officials maintain that local officers have control of the circumstances.

In defiance of descriptions of the city as “war ravaged”, locals have been sharing videos of lush hiking trails and a thriving food scene, and planning activities such as an Emergency Naked Bike Ride against the “militarization of our city”.

Recent Legal Actions

The Tuesday ruling came after a federal judge in the city issued two temporary restraining orders this month – one preventing the federal control of the state troops, and another prohibiting the use of any military personnel in Oregon, after attempts to circumvent the first order by calling up troops from California.

On Monday, the appeals court had put the first ruling on hold – allowing control of 200 Oregon national guard – but the second ruling stayed effective, preventing the actual deployment of the forces.

The Tuesday decision means the issue will be heard by the full court – with both rulings under consideration together – by a group of eleven justices.

“This decision shows that the truth matters and that the courts are working to hold this administration accountable. The founding document restricts the president’s power, and Oregon’s communities cannot be treated as a testing site for expansive government power,” said the legal representative in a statement.

“The judicial body is sending a clear message: the president cannot send the military into American urban areas without cause. We will continue defending state legislation, principles, and autonomy as this legal proceeding moves forward and our fight continues in the judicial system.”
